Gary Anderson remains unlawfully at large after a court overturned Maghaberry’s refusal to let him attend his father’s funeral. The public still lacks the evidence that made a judge reject the prison’s safety assessment.

- Gary Anderson, 29, remains unlawfully at large after leaving HMP Maghaberry on compassionate temporary release on 14 September. The Department of Justice says he was jailed for murder and warns people not to approach him.1
- The Northern Ireland Prison Service had refused Anderson’s application after assessing public-safety risk and the likelihood that he would abscond or reoffend. Justice Minister Naomi Long said it concluded he was not safe for temporary release.2
- A court overturned that refusal on Sunday, ruling that the Maghaberry governor’s decision was not substantiated by the evidence put before it, and ordered Anderson’s release with conditions. The same hearing upheld Magilligan’s refusal to release Anderson’s brother Sean for the same funeral.3
- Anderson absconded from a civilian chaperone approved by the court, not from a prison officer. Police are now searching for a man serving a life sentence for the murder of Karol Kelly.2
This is no longer simply a story about a prisoner failing to return. It is about a system in which the Prison Service judged a murderer too risky to release, a court found that judgment inadequately evidenced, and the public was left carrying the consequence when he disappeared.
Neither the court office’s brief statement nor the minister’s Assembly account explains what evidence failed, what safeguards the court required beyond a civilian chaperone, or how that chaperone was meant to prevent an absconding. Those answers matter. The court’s order was not unlawful; it was a lawful judicial decision. But a decision that overrules prison risk assessors and ends with a police warning not to approach the released prisoner demands a fuller public explanation, with any genuinely sensitive material properly redacted.
